Lasting Powers of Attorney (LPAs) are legal documents that set out who you want to be able to make decisions on your behalf should you have lost mental capacity to make such decisions yourself. You are able to appoint attorneys (usually your loved ones but also paid professionals can act too if required) to make such decisions. There are two types of LPA:
The first concerns decisions in relation to your property and financial affairs.
The second concerns decisions in relation to your health and welfare.
In order to be effective, the LPAs must be signed properly and registered with the Office of the Public Guardian.
A general power of attorney is usually a more straightforward document that can be immediately effective but is unable to be used once you have lost mental capacity.
We can assist with all types of power of attorney to ensure they meet your exact specifications and requirements. This is a highly complex area in which specialist advice is needed.
